DUI Terminology
License Revocation – You may have your license suspended or revoked if you are found guilty of driving under the influence.
Miranda Rights – This is the advisement authorities read to you while you are being placed under arrest. This tells you that you have the right to remain silent, that you have the right to an attorney (and you should take it), along with other rights. The police must read you this advisement or it is an invalid arrest.
Probation – Probation is a set of conditions that an offender must follow in order to avoid jail time or other penalties. Some types of probation require a person to check in with a probation officer, while other types are unsupervised but can be triggered by a subsequent arrest.
Provisional License – A person convicted of DUI may apply for a provisional license that will allow they to drive to and from specific destinations, like work or church.
Subpoena – a subpoena is a written order to produce documents or appear before the court.
Test Contamination – This is one way in which your attorney challenges the legality of BAC test admission. If your attorney can prove the test may have been contaminated, the results will not be admissible in court.
Urine Test – A urine test is another way to detect a person’s BAC. Similar to a blood test, a person must consent to the urine test, or the police must obtain a warrant.
Vehicle Impoundment – A person may have their vehicle impounded or seized by law enforcement in the wake of a DUI arrest.
Zero Tolerance – As we mentioned in part one, the legal driving limit for most drivers is 0.08, but for underage kids or for some drivers with a previous DUI, they may not be allowed to drive with any alcohol whatsoever in their system.
