Halloween can be a spooky night, but it can be especially scary if you end up in handcuffs because you did something you regret. Halloween isn’t our busiest night, but it’s busier than the average night, so we make sure we have plenty of lawyers ready to answer the phones when the calls start to trickle in. We’ll give you some individualized advice during your free case review session, but below, we’re going to give you some general advice for what you should do if you end up getting arrested on Halloween.
Advice After A Halloween Arrest
Obviously taking smart steps to avoid an arrest on Halloween is preferred compared to telling you what to do after the fact, but we’ve already shared those tips on a previous blog. If you’ve been arrested, here’s what you should do.
1. Remain Quiet – You can answer basic questions about who you are or where you live, but avoid giving out information that could be used against you in court. Don’t tell police how many beers you’ve had or say you were speeding because you were late for a Halloween party, because that helps their case. The cops are trying to build a case against you, they are not your friends. You have the right to remain silent – use it.
2. Comply – At the same time, you’ll also want to comply with their requests and be as unmemorable as possible, because the officer will have to testify about the incident from memory. Don’t resist if they put you in handcuffs and don’t get loud or physical. Trust that the legal system will work out in your favor and comply with the directions of the officer.
3. Call a Lawyer – You have the right to seek legal counsel, so be sure to exercise that right. Aside from giving you immediate advice, your lawyer will usually be able to get you out of jail much sooner. This can help you keep your job or avoid stressing your home life. After we’ve secured your release, we’ll go ahead and review the evidence and start planning a strong defense for your case.
4. Stay Out Of Trouble – Finally, the last tip we want to provide is that you need to make smart decisions while your charges are pending. Don’t get another traffic violation while your speeding ticket is pending, and don’t drink alcohol if you’re fighting an alcohol-related charge. Subsequent run-ins with the law will only make it harder for you to win your first case. Follow the instructions of your lawyer and make smart decisions while your case is pending.
