Minnesota is full of picturesque trails perfect for exploring on an off-road vehicle like an ATV. However, ATVs and other off-road vehicles like snowmobiles and dirt bikes all meet the classification for a motorized vehicle in Minnesota. Minnesota defines an off-road vehicle as any motor-driven vehicle capable of cross country travel without using a road. Since an ATV meets the classification of a motor vehicle, drivers are held to very similar standards as normal vehicles when it comes to drinking and driving.

ATV DUI Penalties in Minnesota
Under Minnesota law, you can face both criminal and civil penalties if you are caught operating an ATV under the influence of alcohol. We’ll start with the criminal penalties. If you are caught driving an ATV under the influence of alcohol, you will likely be charged with 1st offense DWI, which is a misdemeanor charge carrying the possibility of up to 90 days in jail and fines up to $1,000.
However, just like a DUI in a car, that charge can be upgraded based on the circumstances. If you injure someone, have minors on the ATV with you, if you’ve had prior DUIs or you blow above a 0.16, that charge can be upgraded to a gross misdemeanor or even a felony. These all carry the possibility of more jail time and increased fine amounts. You can also lose your driver’s license.
On the civil side, although a 1st offense DWI won’t result in the loss of your driver’s license, the state will likely suspend your privileges to operate an ATV for one year. This can be extended to other recreational vehicles as well if the court deems it necessary.
