Collateral Consequences for Criminal Sexual Conduct Minnesota

A conviction of any degree of criminal sexual conduct can result in the revocation of many of your civil liberties, even if you don't go to jail. These collateral consequences are outlined below.

Registration:

If you are ultimately convicted of any degree of criminal sexual conduct, you must register as a predatory offender. Failure to adequately register is a felony and punishable by up to five years of imprisonment and a $10,000 fine.

Conditional Release:

If you are ultimately convicted of any degree of criminal sexual conduct and sentenced to prison, upon release you will be subject to conditions. Failure to meet these conditions could result in you going back to prison. The conditions of release may include successful completion of treatment and aftercare in a program approved by the commissioner and any other conditions the commissioner considers appropriate. If the offender fails to meet any condition of release, the commissioner may revoke the offender's conditional release and order that the offender serve all or a part of the remaining portion of the conditional release term in prison.

Civil Commitment:

If you are convicted of any of the above crimes, before you are released from prison the commissioner shall make a preliminary determination whether a petition for commitment as a sexually dangerous person is necessary. This can happen if you are deemed a high risk category or repeat offender. The commissioner's opinion must be based on a recommendation of a Department of Corrections screening committee and a legal review and recommendation from independent counsel knowledgeable in the legal requirements of the civil commitment process.
